Taking Your SSDI Claim As Far As Necessary

Reconsideration — If you filed your own claim and it was rejected, you have 60 days to resubmit the claim to the Social Security Administration for reconsideration. You should contact an attorney at this point. We know what additional documentation will bolster your claim.

ALJ Hearing — If you are denied on reconsideration, you have 60 days to request a disability hearing before an administrative law judge. Our attorneys can collect and update your medical records and sift through the statutes and regulations to prepare points for appeal: a doctor’s opinion of your limitations, age or educational factors that affect employability, showing that you meet the criteria for a specific SSDI listing.

Sometimes new documentation submitted during the long delay results in an on-the-record decision in your favor. If not, a hearing date will be set. We will sit down with you before the hearing to go over your testimony. We also attend and personally represent you at the hearing.

Appeals Council — We can ask the SSA Appeals Council to review an adverse ALJ decision. We submit a brief and set forth an argument to overturn the denial of benefits. The Council can overrule the ALJ and grant your benefits, reject your appeal, or send it back to the ALJ.

Federal Appeals — When administrative appeals are exhausted, filing suit in federal district court for review of the case is the next level of appeal.
