How Do I Know If I Have A Valid Social Security Disability Claim?
To qualify for a valid Social Security Disability claim under federal law, you must generally meet two main requirements: you must have worked long enough and recently enough in jobs covered by Social Security to be “insured,” and you must have a medical condition that meets the Social Security Administration’s (SSA) strict definition of disability. Specifically, your condition must be a “medically determinable” physical or mental impairment that prevents you from performing any substantial work (earning above $1,690/month in 2026 for non-blind individuals) and has lasted or is expected to last for at least 12 months or result in death.
Filed Your Own Application?
In some cases, you may be better off filing your own application the first time and avoiding the expense of paying for services until you truly need to retain an attorney. If you have filed your own application, continue seeing your doctor to document your disability. If the SSA rejects your claim, let us help! Call Mossman Law Office! We believe there is no need to pay for services until you need us!
Haven’t Applied Yet?
Mossman Law Office can guide you through this frustrating process. During an already stressful time, the Social Security Administration will make you “jump through hoops” to get qualified for benefits. Mossman Law Office has a record of success at all stages of the process.
- Application — Helping you submit your original claim
- Reconsideration – Resubmitting your claim with additional documentation
- Hearings – Preparing you to state your case before an administrative law judge (ALJ)
- Appeals – Asking an administrative panel or federal court to overturn an adverse decision
Social Security Disability Insurance (SSDI) is a federal program providing benefits to those who can no longer support themselves through regular employment because of a qualifying physical or mental impairment. Supplemental Security Income (SSI) provides similar benefits to those who have never worked or do not have sufficient work credits to receive SSDI, and who are poor. Eligibility for SSDI or SSI depends on many factors: your work history, your income, the degree and duration of your disability, and proving you cannot work.
How Can A Social Security Disability Lawyer Help?
Having an attorney who is familiar with the rules, medical issues and complex bureaucracy can (a) increase the likelihood that your rejected claim is approved as soon as possible and (b) maximize the benefit amount you are entitled to receive.
As sustaining members of the National Organization of Social Security Claimants’ Representatives (NOSSCR) who practice full-time in Social Security and work injury law, attorneys Taylor Mossman-Fletcher, Barbara Harper and Britney Ocampo can ensure that your paperwork will be in order, advise on steps you can take to help your claim and protect your interests in all proceedings.
We keep clients informed about the progress of the case, and we operate on a contingency-fee basis, which means we charge no fee unless we succeed in securing benefits for you.
What Is The Biggest Difference Between Applying For SSD In Idaho And Oregon?
Oregon does not tax Social Security benefits. Idaho may tax a portion of benefits depending on your total income. Additionally, residents in Oregon may have easier access to the Oregon Health Plan (Medicaid) during the two-year Medicare waiting period compared to the programs available in Idaho.
How Do You Appeal An SSD Decision?
There are many complicated steps to an appeal:
- Within 60 days of receiving your denial letter, file a written request for reconsideration.
- If the state denies this request, you should request a hearing with an Administrative Law Judge (ALJ).
- If the judge issues a denial, request a hearing with the SSA Appeals Council.
- If the council still denies the petition, you can file a lawsuit with the U.S. District Court.
Because the wait for a hearing can exceed 12 to 24 months, it is important to file your appeal correctly the first time.
